1. Definitions

  1. CONTACT FORM - a form available on the resider.pl website allowing the Service Recipient to contact the Service Provider directly.
  2. WEBSITE / PORTAL - resider.pl website.
  3. REGULATIONS - these website regulations.
  4. SERVICE PROVIDER - RESIDER SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, registered office: ul. Zwycięzców 40/80 03-938 Warsaw, delivery address: ul.   5. SERVICE RECIPIENT - a natural person, legal person, or organizational unit without legal personality, which the law grants legal capacity to benefit from an Electronic Service.
  6. ELECTRONIC SERVICE - a service provided electronically by the Service Provider to the Service Recipient through the Website.
  7. NEWSLETTER - An Electronic Service allowing the Service Recipient to subscribe and receive free information from the Service Provider at the email address provided by the Service Recipient.
  8. NOTICE BOARD - a webpage allowing the publication of real estate ads
  9. ADVERTISER - Legal or natural person publishing ads on the Notice Board

2. General provisions

  1. The resider.pl website operates according to the rules specified in these Regulations.
  2. The Regulations specify the types and scope of services provided electronically by the resider.pl Website, the principles of providing these services, the conditions for concluding and terminating contracts for electronic services, as well as the complaint procedure.

  4. Every Service Recipient, upon taking actions aimed at using Electronic Services of the resider.pl Website, is obliged to comply with the provisions of this Regulations.
  5. Matters not regulated in these Regulations are governed by the provisions
  • Act on the provision of electronic services of July 18, 2002 (Journal of Laws No. 144, item 1204 as amended),
  • Consumer Rights Act of May 30, 2014 (Journal of Laws 2014, item 827),
  • Civil Code of April 23, 1964 (Journal of Laws No. 16, item 93 as amended), and other relevant provisions of Polish law.
  1. The Service Provider acts as a comparison website and does not have its own real estate ads - all ads published on the Website come from Ad Boards managed by the Portal. Contact with Advertisers is possible only after being redirected to the ad page.
  2. The Service Provider does not engage in real estate rental or sales intermediation.
  3. The Service Provider is not responsible for the content or currency of aggregated offers. The Service Provider is not responsible for the consequences of the Advertiser providing untrue, outdated, or incomplete information (including the Advertiser's contact information). The Advertiser is solely responsible for the content of published offers and the consequences of providing incomplete, outdated, or untrue information.

3. Portal functionalities

  1. The Portal aggregates real estate sales and rental offers in selected locations available in supported Ad Service:

  1. The Portal provides a search service for users and saves aggregated real estate offers on an individual User account.
  2. The key functionalities of the search engine include:
  3. Access to offers from multiple ad services without duplicates.
  4. Sorting offers by their Relevance. Offer relevance is assessed as a combination of price attractiveness (calculated by artificial intelligence based on the mechanism of estimating the market price of an apartment) and the time since the offer was listed (the relevance of the offer degrades over time). Sorting by relevance is a primary sort, and sorting by the main offer parameters such as price, area, or days since publication is also possible.
  5. Filtering offers by geo-analytical data including:
  • estimated travel time from the property to any point in Warsaw by car or public transport
  • distance from the property to the nearest metro station
  1. Filtering total rental costs and amenities using artificial intelligence, which seeks information both in the ad parameters and text.
  2. Information on price changes of an ad
  3. Saving watched offers and the ability to compare them on a map
  4. Access to the full functionalities of the Portal requires logging in to the Portal (creating an individual User account by correctly filling out the "create account" form available on the Portal's pages) and paying a weekly subscription. The agreement for an Electronic Subscription service to use the Searcher service comes into effect on the date of payment and is confirmed by an email sent to the address provided by the User on the registration form, along with information referred to in art. 12 sec. 1 of the Act of May 30, 2014 on consumer rights, and possibly confirmation of the request to start providing the service before the expiry of the withdrawal period, consent to perform the contract in full before the expiry of the withdrawal period, and consent by the User to provide digital content under circumstances resulting in the loss of the right to withdraw from the contract, if any of these consents were given. The waiting time for confirmation of correct online payment does not exceed 24 hours. The weekly subscription cost is 5 PLN, the price includes VAT. The subscription is automatically renewed after a period of 7 days unless it is disabled by the User. For new Users who have never logged into the portal before, there is a possibility of a 3-day, free trial period. Payments are handled by Stripe.com in accordance with the terms specified on the payment processing page. Using the selected payment method implies consent to the processing of personal data by the payment operator, concerning the payment maker, to confirm its completion. Granting paid functionalities of the Portal to the user occurs after receiving confirmation of the transaction's successful course.
  5. The Service Provider makes every effort to ensure that all current real estate sales and rental ads from supported cities and Ad Services are visible on the Portal. Due to technological limitations, some offers may be omitted in the ad aggregation process. The Service Provider is not responsible for any omissions in ads published in supported Ad Services.
  6. The Service Provider strives, utilizing advanced analytics and machine learning, to eliminate duplicates of ads in the Portal:
  7. publication in the Portal of two or more ads concerning the sale or rental of different apartments as duplicates of a single ad - (for example, for very similar apartments in the same building).
  8. publication in the Portal of more than one ad concerning the sale or rental of the same apartment - (for example, apartments for which two agencies put up different locations).

The Service Provider makes every effort to keep this information up-to-date and accurate, but is not responsible for any inaccuracies or discrepancies in this regard.

  2. The Portal uses machine learning to extract key offer parameters, such as amenities or additional administrative rent costs, from the description. The algorithms used have high accuracy, but there is a possibility of misclassification:

  4. Incorrect classification of a cost/amenity

The Service Provider is not liable for algorithm errors. To avoid misunderstandings, it is recommended to confirm the final terms of the offer directly with the Advertiser.

4. Type and scope of electronic services

  1. The Service Provider allows the use of Electronic Services such as:
  • using the Real Estate Ad Searcher
  • using the Contact Form,
  • using the Newsletter,
  1. The provision of Electronic Services to Service Recipients specified in Section III point 1 of the Regulations by the Service Provider is free of charge.
  2. The duration for which the contract is concluded:
  • the contract for providing an Electronic Service consisting of enabling sending a message via the Contact Form is concluded for a specified period and is terminated upon sending the message or discontinuation of its sending by the Service Recipient.
  • the contract for providing an Electronic Service consisting of using the Newsletter is concluded for an indefinite period.
  1. Technical requirements necessary for cooperation with the teleinformatic system used by the Service Provider:
  • computer with internet access,
  • access to email,
  • web browser,
  • enabling Cookies and Javascript in the web browser.
  1. The Service Recipient is obliged to use the Website in a manner compliant with the law and good manners, considering respect for personal rights and intellectual property rights of third parties.
  2. The Service Recipient is obliged to enter data consistent with the actual state of affairs.
  3. The Service Recipient is prohibited from providing unlawful content.

6. Conditions for terminating contracts for electronic services

  1. Termination of a contract for providing an Electronic Service:
  • A contract for providing a continuous and indefinite Electronic Service (e.g. using the Newsletter) may be terminated.
  • The Service Recipient may terminate the contract with immediate effect and without stating reasons by sending a relevant statement via email to the address:

  • The Service Provider may terminate the contract for providing a continuous and indefinite Electronic Service in case the Service Recipient violates the Regulations, specifically by providing unlawful content after ineffective prior requests to cease violations with a specified deadline. The contract terminates 7 days after the declaration of intent to terminate it (termination period).
  • Termination results in the termination of the legal relationship for the future.
  1. The Service Provider and the Service Recipient may terminate the contract for providing Electronic Services at any time by mutual agreement.

7. Complaint procedure

  1. Complaints related to the provision of Electronic Services by the Service Provider:
  • Complaints related to the provision of Electronic Services via the Website can be submitted by the Service Recipient via email to the address:

  • In this email, provide as much information and circumstances regarding the complaint, specifically the type and date of irregularities, and contact details. Providing these details significantly facilitates and expedites the examination of the complaint by the Service Provider.
  • The Service Provider shall consider a complaint promptly, no later than within 14 days.
  • The Service Provider's response to the complaint shall be sent to the Service Recipient's email address provided in the complaint report or in another manner specified by the Service Recipient.

8. Intellectual property

  1. All content posted on the resider.pl website is protected by copyright law and is the property of resider.pl. The Service Recipient is fully responsible for any damage caused to the Service Provider as a result of using any website content without the Service Provider's consent.
  2. Any use without the explicit written consent of the Service Provider of any elements comprising the content of the resider.pl site constitutes a copyright infringement belonging to the Service Provider and results in civil and criminal liability.

9. Final provisions

  1. Contracts made via the Website are made in accordance with Polish law.
  2. In case of any discrepancy between any part of the Regulations and the applicable law, the relevant provisions of Polish law shall apply in the place of the disputed Regulations.
